Welcome to EDUTEK. By accessing or using our website, software, and services (“Platform”), you agree to be bound by these Terms of Service (“Terms”). If you are entering into these Terms on behalf of a school or organisation, you represent that you have the authority to bind that entity. If you do not agree, do not use the Platform.
You must be at least 18 years old or have parental/guardian consent to use the Platform. Schools are responsible for ensuring that their staff and students comply with these Terms.
To use the Platform, you must register an account. You agree to provide accurate, current, and complete information. You are responsible for safeguarding your password and for all activities that occur under your account. Notify us immediately of any unauthorised use. We reserve the right to suspend or terminate accounts that violate these Terms.
4.1 Pricing & Billing. Subscription fees are displayed on our pricing page and are charged per term (3 months) or per year, depending on your selection. Fees are payable in advance via Paystack. All fees are in Nigerian Naira (₦) and inclusive of VAT (where applicable).
4.2 Automatic Renewal. Subscriptions renew automatically at the end of each term unless you cancel before the renewal date. You will be notified via email at least 7 days before renewal. You can cancel anytime from your dashboard.
4.3 AI Credits. AI credits are purchased separately as add‑ons. Credits never expire and are non‑refundable once consumed. Unused credits may be transferred to another school under the same organisation upon request.
4.4 Taxes. You are responsible for any applicable taxes (e.g., VAT). If we are required to collect taxes, they will be added to your invoice.
Refund Policy: If you are not satisfied within the first 14 days of your initial paid term, we will refund the full amount. After 14 days or for subsequent terms, fees are non‑refundable because we have already incurred costs for server resources, support, and third‑party integrations. AI credits are non‑refundable once purchased.
5.1 By You. You can cancel your subscription at any time from your dashboard. Cancellation will take effect at the end of your current term. No further charges will be billed after cancellation. You will continue to have access until the term ends.
5.2 By Us. We may suspend or terminate your access immediately if you violate these Terms, fail to pay fees, or engage in activities that harm the Platform or other users. We will notify you via email. Upon termination, you must stop using the Platform, and we may delete your data after 90 days (unless earlier deletion is requested).
You agree not to:
7.1 Your Data. You retain all ownership rights to the data you upload (student names, results, fee records, etc.). We do not claim ownership of your data.
7.2 Our License. By using the Platform, you grant us a limited, non‑exclusive license to host, store, and process your data solely to provide the services. You also grant us permission to use aggregated, anonymised data to improve the Platform (e.g., performance benchmarks).
7.3 Intellectual Property. The Platform’s code, design, logos, and trademarks are owned by EDUTEK or our licensors. You may not copy, modify, or distribute them without permission.
Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your data.
The Platform integrates with third‑party services, including Paystack for payments and Google Analytics for usage statistics. We are not responsible for the actions or data practices of these third parties. Your use of Paystack is subject to their terms of service.
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR‑FREE, OR SECURE. WE DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EDUTEK AND ITS DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA, OR REPUTATIONAL HARM, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
You agree to indemnify and hold harmless EDUTEK and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising out of your violation of these Terms, your misuse of the Platform, or your infringement of any third‑party rights.
We may update the Platform or these Terms from time to time. If we make material changes to the Terms, we will notify you via email or dashboard notice. Continued use of the Platform after the changes become effective constitutes your acceptance of the revised Terms. If you do not agree, you may cancel your subscription before the changes take effect.
These Terms shall be governed by the laws of the Federal Republic of Nigeria. Any dispute arising from these Terms shall first be attempted to be resolved through good faith negotiations. If unresolved within 30 days, the dispute shall be submitted to arbitration in Abuja, Nigeria, in accordance with the Arbitration and Conciliation Act. The arbitrator’s decision shall be final and binding.
